Requirements:

A Law degree (NQF level 7 qualification as recognized by SAQA) is required, along with 3-5 years of experience in litigation, investigation, and court-related work. Additionally, candidates should possess 3-5 years of junior management experience at the Assistant Director level. A valid Code 8/10 driver’s license is essential.

Duties:

Oversee the formulation and execution of plans, policies, legislative frameworks, procedures, and systems to institutionalize Consumer Protection matters within GDED. Provide guidance on legislative issues. Prepare monthly reports that include statistical data and narratives on cases, evaluations, status updates, and monetary assessments. Conduct research and analysis on Consumer Protection topics. Analyze data to identify trends in unfair business practices prevalent in specific industries for investigations initiated by the office. Identify the reasons for delays in the resolution of complaints under investigation. Review investigation reports and implement necessary actions. Supervise the management of consumer complaints by investigators and verify or reassess the decisions made. Investigate and resolve cases involving alleged unfair business practices.

Address escalated cases referred to the office. Draft and facilitate the issuance of summons and subpoenas to individuals responsible for unfair business practices or conduct detrimental to consumers. Present cases in the Consumer Court. Collaborate with cluster departments within the Province to enhance Consumer Protection initiatives being undertaken by various departments, aiming to foster an investor-friendly environment through cohesive and structured consumer participation efforts. Represent consumers who have been adversely affected by unfair business practices in the Consumer Affairs Court. Work in conjunction with the Communication Unit on Consumer Protection initiatives. Engage with Provincial Consumer Protection and other Regulatory Authorities regarding Consumer Protection matters. Manage the utilization of physical resources.

Evaluate and monitor employee performance and conduct appraisals.Oversee the capacity and professional growth of personnel. Foster and sustain employee engagement while promoting a culture centered on performance management. Establish budgetary needs for the department in accordance with guidelines and the Public Finance Management Act (PFMA) requirements. Secure approval through the governance structures of the Department of Economic Development (DED), implement actions, and report in alignment with the received approvals. Ensure timely responses to audit inquiries.
